By accessing and using PesaTrace services, you accept and agree to be bound by the terms and provision of this agreement.

If you do not agree to abide by the above, please do not use this service.

These terms apply to all users of the service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

PesaTrace provides a comprehensive fintech platform for business owners and agents to manage transactions, mobile money, and banking operations.

Our services include but are not limited to: transaction processing, agent management, analytics and reporting, mobile money integration, and customer support.

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.

To use our services, you must register for an account and provide accurate, complete, and current information.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately of any unauthorized use of your account or any other breach of security.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

PesaTrace operates in compliance with applicable financial regulations including but not limited to Central Bank of Kenya (CBK) guidelines.

All financial transactions are subject to anti-money laundering (AML) and know your customer (KYC) requirements.

We reserve the right to verify your identity and business information at any time.

Transaction limits and fees may apply as outlined in your service agreement and pricing plan.

You may not use our services for any unlawful purpose or to solicit others to perform unlawful acts.

You may not violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances.

You may not transmit any worms, viruses, or any code of a destructive nature.

You may not breach or circumvent any security measures of our platform.

You may not use our services to process fraudulent or unauthorized transactions.

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of our services.

We collect, use, and protect your personal information in accordance with applicable data protection laws.

We implement appropriate security measures to protect your personal and financial information.

We may share your information with third parties only as described in our Privacy Policy or as required by law.

The PesaTrace service and its original content, features, and functionality are and will remain the exclusive property of PesaTrace and its licensors.

The service is protected by copyright, trademark, and other laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

In no event shall PesaTrace, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages.

Our total liability to you for all damages, losses, and causes of action shall not exceed the amount you have paid to PesaTrace in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages.

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion.

If you wish to terminate your account, you may simply discontinue using the service.

Upon termination, your right to use the service will cease immediately.

All provisions which by their nature should survive termination shall survive termination.

These terms shall be interpreted and governed by the laws of Kenya, without regard to its conflict of law provisions.

Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

We reserve the right, at our sole discretion, to modify or replace these terms at any time.

If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms.
